Ultimate Man is an online retail platform operating through www.ultimateman.com, offering a curated range of premium men's clothing and apparel across India.
This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
Please read these Terms and Conditions carefully before accessing or using our platform. By using our platform, you agree to be legally bound by these terms.
1. Acceptance of Terms
1.1 Any person who accesses and/or uses the Ultimate Man platform in any manner shall be subject to these Terms and Conditions and all policies formulated by Ultimate Man.
1.2 These Terms and Conditions, along with our Privacy Policy, Shipping Policy, and Refund & Cancellation Policy, collectively constitute a legally binding agreement between you and Ultimate Man in connection with your access to and use of the platform.
1.3 Ultimate Man reserves the right to update, modify, or amend these Terms at any time, with or without prior notice. It is your responsibility to review these Terms periodically.
1.4 By continuing to use the platform, you signify your acceptance of these Terms. If you do not agree to be bound by these Terms, please discontinue use of the platform immediately. These Terms supersede all previous terms and conditions communicated to you.
1.5 In addition to these Terms, you may be required to comply with the terms and conditions of third-party services whose links or integrations are available on our platform. Ultimate Man shall not be held liable for any transactions between you and such third parties.
2. Registration
2.1 In order to avail our services, you may be required to register on the platform. Registration is a one-time, free-of-cost process. You may register by:
- Creating an Ultimate Man account by providing the relevant personal details. An account with a unique username and password will be created for you upon successful registration.
- Using a third-party account (such as Google or Facebook), in which case you will also be subject to the terms and conditions of that third-party platform.
3. User Warranties and Restrictions
3.1 You may use the platform for lawful purposes only. You are granted a limited, non-transferable license to access and use the platform solely for the purpose of purchasing products and availing our services, subject to these Terms.
3.2 You shall not:
- Delete or modify any content on the platform, including but not limited to product information, pricing, legal notices, trademarks, or proprietary notices that you do not own or have express permission to modify;
- Decompile, reverse engineer, or disassemble any part of the platform or its content;
- Use the platform in any manner that is unlawful or harmful to Ultimate Man or any other person or entity;
- Use automated tools such as bots, spiders, crawlers, or similar mechanisms to navigate, scrape, or search the platform;
- Make false or malicious statements against our platform, services, or brand;
- Upload or transmit any files containing viruses, malware, or any other harmful components that may impair the platform or its users;
- Engage in antisocial, disruptive, or destructive behaviour including spamming, phishing, or trolling;
- Post or upload any content that is abusive, defamatory, hateful, obscene, or otherwise violates any applicable law or third-party rights.
3.3 You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to immediately notify Ultimate Man of any unauthorised use of your account or any security breach. Ultimate Man will not be liable for any loss arising from your failure to keep your account information secure.
3.4 You represent and warrant that: (a) you are 18 years of age or older; (b) your use of the platform will not violate any applicable law or regulation; and (c) all information submitted by you is true, accurate, and complete.
4. Intellectual Property and Content
4.1 All content, information, and materials on the platform — including text, graphics, images, logos, software code, interface design, and trademarks — are the exclusive intellectual property of Ultimate Man or its licensors. No content may be copied, reproduced, uploaded, transmitted, or distributed in any form without our prior written permission.
4.2 Ultimate Man grants you a limited, revocable licence to access and use the platform solely for personal, non-commercial purposes such as browsing products, making purchases, and processing returns. This licence does not permit any resale, commercial use, or derivative use of our content or product listings.
4.3 By submitting any review, feedback, comment, or other content on the platform, you grant Ultimate Man a royalty-free, perpetual, irrevocable, non-exclusive licence to publish, reproduce, distribute, and use such content in any form or medium, worldwide. You waive any claim in relation to such content once submitted.
5. Orders, Payments and Delivery
5.1 The display of products on our platform constitutes an invitation to offer. Placing an order constitutes an offer by you to purchase the product. All orders are subject to product availability, acceptance by Ultimate Man, and your continued adherence to these Terms.
5.2 We accept the following payment methods: UPI, Credit/Debit Card, Net Banking, and Cash on Delivery (COD). All payments are subject to our Fees and Payment Policy.
5.3 Upon successful payment — or upon placing a COD order — your product will be delivered in accordance with our Shipping Policy.
5.4 You may cancel an order or return a product in accordance with our Refund & Cancellation Policy.
6. Disclaimer of Warranties
6.1 Ultimate Man endeavours to keep the platform accessible and error-free. However, access may be temporarily suspended for maintenance, repairs, or the introduction of new features. We are not responsible for access issues arising from internet connectivity problems at your end.
6.2 Product images and visual representations on the platform are provided as a guide to assist you in identifying products. While we make reasonable efforts to ensure accuracy, the actual product delivered may differ slightly in appearance due to display settings, lighting conditions, or manufacturing variations.
6.3 All services on the platform are provided on an "as is" and "as available" basis without any express or implied warranties. Ultimate Man does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful elements.
7. Indemnification and Limitation of Liability
7.1 You agree to indemnify, defend, and hold harmless Ultimate Man, its officers, directors, employees, agents, and representatives from and against any third-party claims, losses, liabilities, damages, or costs (including reasonable legal fees) arising from your use of the platform, violation of these Terms, or infringement of any intellectual property or other rights.
7.2 To the fullest extent permitted by law, Ultimate Man shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to your use of, or inability to use, the platform or its services.
7.3 In any event, Ultimate Man's maximum liability to you shall be limited to the value of the order amount in question.
8. Communications and Notifications
By registering on our platform, you consent to receiving notifications from Ultimate Man via SMS or email. These may include updates about your orders, account activity, and promotional offers. You may unsubscribe from marketing communications at any time by following the opt-out instructions provided in such communications or by contacting us directly.
9. Term and Termination
9.1 These Terms are effective from the date of their publication on the platform.
9.2 Ultimate Man reserves the right to suspend or terminate your access to the platform in the event of any breach of these Terms, misrepresentation of information, or any unlawful activity.
9.3 You may terminate your use of the platform at any time. Termination does not relieve you of any outstanding obligations, including payment for purchases already made.
10. Force Majeure
Ultimate Man shall not be held responsible for any delay or failure to fulfil its obligations where such delay or failure arises from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, civil unrest, or failures of third-party systems.
11. Waiver
No provision of these Terms shall be deemed waived unless such waiver is in writing and signed by Ultimate Man. Any waiver of a breach by a user shall not constitute a waiver of any subsequent or different breach.
12. Severability
If any provision of these Terms is found to be unenforceable under applicable law, that provision shall be excluded, and the remaining Terms shall continue in full force and effect. The excluded provision shall be interpreted so as to give the greatest possible effect to its original intention.

14. Governing Law and Dispute Resolution
These Terms and all transactions between you and Ultimate Man shall be governed by the laws of India, without reference to any conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi.
